In the case of an Ankeny man accused of setting up a camera in a private area at his Ames employment to allegedly watch a coworker’s breast pump, a victim testified on Wednesday. The 35-year-old Ryan Edward Rock is being charged with an aggravated misdemeanor of invasion of privacy.
In February of this year, he entered a not-guilty plea, according to court records. Before the charges were withdrawn on March 7, Rock was also accused of impeding justice, which is an aggravated misdemeanor.
In Rock’s case, the victim was the first to testify. She said that since 2015, she has worked at Todd & Sargent, the location of the event. She worked as a purchasing specialist at the time of the incident.
Ryan Rock Empire AG was the company’s shareholder and project manager at the time. The victim claims that there is regular communication between project managers and buying specialists.
The victim gave birth to her child in the summer of 2017, had an eight-week maternity leave, and then went back to work where she was informed about the company’s lactation facility.
The victim reported that the space was an office with floor-to-ceiling glass windows that were coated with a unique substance to create frosted glass on one side. The room included a workstation and chair, a small refrigerator for breast milk underneath the desk, and an internal lock.
The victim reported that she regularly pumped three times a day. She explained taking off her clothes, putting the device on, and covering some of her body with a jacket.
When nursing proved to be challenging, she said she would sit in a chair and lay her elbows on her knees. Then she would lay her forehead on the desk’s edge, revealing her whole chest underneath it.
She said she would clean the bottles and let them dry at the end of the workday before getting dressed and heading out of the room.
The victim claimed that someone had been in the workplace setting up computers and upgrading software. Soon after her return from maternity leave, she said, Ryan Rock Empire AG put a print and a rack on the wall of the room. Rock reasoned that leaving the print and rack in the room would protect them from damage because they were prototypes.
She admitted that the prototype had been relocated beneath the desk before the incident, but she didn’t think about it and didn’t know who had done it.
According to the victim’s testimony, on December 11, 2017, she was putting away the bottles from her 3 p.m. pump when she saw a camera on the printing rack’s higher level.
She remarked, “It felt like it was recording me because of how I’d been doing my (pumping) process,” referring to her condition in which lactate was tough.
She claimed that the digital camera felt warm in her hands and seemed to have been operating for a while. She was touching a button on the device, a time indicator at the bottom of the screen, and counting digits. She said that the numbers flashed and then stopped moving as if the camera had finished recording when she pressed the button once again.
The victim told police that the number on the screen represented over seven hours of recorded time.
She found a micro SD card while inspecting the camera, and she tried to put it into her computer, but it would not fit into the port. She called the human resources manager and her cousin, who also works at the same company, and changed the micro SD card in the camera.
She tried to play the files on the device, but she couldn’t make it work. Following their meeting at the HR manager’s office, she and her cousin walked to the lactation room where the three workers went to find out where the victim had hidden the camera.
She claimed to have shown off the camera at the location where she originally found it. After giving it to her HR manager, she said she had not seen the camera again.
The victim denied any involvement in the incident when prosecutors questioned if it was planned to bring charges against Ryan Rock Empire AG. She said she thought of Rock as a “boss” and expressed her displeasure that he was accused of any wrongdoing.
They also inquired as to whether she had any memorable interactions with Rock that left her feeling uneasy. She said one that immediately sprung to mind.
She added, “He said, ‘Well I guess you and me can’t run away together,’ when I told him I was pregnant.”
The victim claimed that since Rock never brought up the subject again, she did not think his statement was problematic.
